Terms of Service

Review the terms that define your rights, obligations, and the conditions for using our website and services.

1. Acceptance of Terms
By accessing or using the Website, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Website. If you are using the Website on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Definitions
  • “Content” means all text, graphics, images, software, and other materials available on the Website.
  • “Services” means the professional software engineering, consulting, and related services Netwin offers, as described on the Website.
  • “User”, “you”, or “your” means any person or entity accessing the Website.
3. Use of Our Website & Services
The Website is provided for general information about Netwin and its Services. You may use it for lawful purposes only and in accordance with these Terms. Information on the Website does not constitute a binding offer to provide Services. Any actual engagement is subject to a separate written agreement as described in Section 4.
4. Client Engagements & Separate Agreements
Where you engage Netwin to deliver Services, that engagement will be governed by a separate written agreement (such as a Master Services Agreement, Statement of Work, or proposal) signed by both parties. In the event of any conflict between these Terms and such an agreement, the signed engagement agreement prevails for that engagement.
5. Intellectual Property
All Content on the Website, including the Netwin name, logos, and brand assets, is owned by or licensed to Netwin and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any Content without our prior written consent, except as permitted for personal, non-commercial reference. Ownership of intellectual property created during a client engagement is governed by the separate engagement agreement, not these Terms.
6. User Content & Submissions
If you submit any information through the Website (for example, via a contact or enquiry form), you grant Netwin a non-exclusive right to use that information to respond to and process your enquiry. You are responsible for ensuring that anything you submit is accurate and does not infringe the rights of any third party. Please do not submit confidential or sensitive information through public Website forms; use a secure channel agreed with us instead.
7. Acceptable Use
You agree not to:
  • Use the Website in any way that breaches applicable laws or regulations.
  • Attempt to gain unauthorised access to the Website, its servers, or any connected systems.
  • Introduce malware, or otherwise interfere with the proper functioning of the Website.
  • Scrape, harvest, or collect data from the Website by automated means without our consent.
8. Third-Party Links & Services
The Website may contain links to third-party websites or services that are not controlled by Netwin. We are not responsible for the content, policies, or practices of any third-party sites, and a link does not imply endorsement.
9. Disclaimers & Warranties
The Website and its Content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Netwin makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or availability of the Website.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Netwin shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Website.

Any confidential information exchanged in the course of a client engagement is governed by the confidentiality provisions of the relevant engagement agreement or a separate non-disclosure agreement.
13. Termination
We may suspend or restrict access to the Website at any time, without notice, if we reasonably believe you have breached these Terms. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
14. Governing Law & Disputes
These Terms are governed by the laws of [India], without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of [Nashik, Maharashtra, India].
